This vacation rental agreement is a legal contract between  Trifecta Realty and Property Management  (also referred to as the “Host”) and (Registered Guest/s or Tenant/s).

This agreement is entered into on the date the Guests’ online reservation is screened and accepted by Trifecta Realty & Property Management. Trifecta Realty & Property Management reserves the right to refuse or cancel services.

PAYMENT POLICY

Payments will be made in compliance to AirBnB and VRBO. The full amount of lodging, taxes and fees are listed on the property. 

The Property Manager reserves the right to cancel the reservation if all monies and completed paperwork are not received by the date due. There are NO REFUNDS except as stipulated in the Airbnb or VRBO reservation. We require Guests to acquire Travel Insurance independently to protect their investment if they must cancel for an emergency or other reason. 

We do not provide a daily cleaning service and linen supply. The final cleaning service is included in your reservation. However, you are responsible for the following:  Rental Agreement & About the Property (below).

RENTAL AGREEMENT

** By booking this property, you are agreeing to the following SIMPLE RULES **

Rule #1  NUMBER OF PEOPLE, AGE & ADDITIONAL GUEST(S)

Max number of people: Please strictly follow the number of people allowed/specified on the platform(s) to the house you are staying in. If you are going to exceed this amount, then you need permission prior to the start of your stay to do so. The properties have cameras outside, so we will know if this contract term is violated. If this contract term is violated (without written permission), you will be subject to a fine of up to $250 per person over the reservation in addition to immediate removal from the property without refund. Please do not misrepresent your use of the property or the number of people that will be there.

No Additional Guest (s):  Daytime guests (visitors) might be approved to visit during regular hours – we require that those names be submitted in advance and approved prior to your stay. . If you wish to request approval for a visitor not listed on the Vacation Rental Agreement – message us in the Airbnb or VRBO app for pre-approval prior to your arrival. Only pre-approved visitors and registered guests may visit the property.  After 10 pm, no visitors on the property, per the City of Henderson ordinance. Violation of this provision will result in immediate removal without a refund.  Guests are not to let or sublet any part of the premises, nor assign the lease or any interest in it. Any fines levied by the City of Henderson or the Security Company will be passed on 100% to the guest. In addition, we do require a $500 fully refundable incidental charge   If we get any charge from the City, it will be deductible from that holding fee.

Guest(s) Age:  All adult guests must be at the  Minimum age of 30 unless they are an adult child of a guest.  ID is required to be sent prior to the day of arrival for all guests and it will be checked at check-in.  It needs to be texted to the number we provide or emailed to the email we will give you. We will sometimes make exceptions so please ask prior to making your reservation.

Rule #2  NO PARTIES OF ANY KIND 

This is strictly Enforced!  The maximum number of people in the home should not exceed the number of approved guests + pre-approved visitors at any time. While we want you to enjoy our property fully, the City is monitoring us very closely and we risk losing our license if we exceed the maximum number of guests. In addition to being fined for additional guests, you will be asked to leave the property promptly, Outdoor cameras monitor the movement of people in and out of the house for everyone’s safety. These cameras are required by the City and can be reviewed by them at any time to ensure compliance. Finally, any fines levied by the City of Henderson or the security company will be passed on 100% to the guest.

If neighbors call code enforcement or the police to complain about noise from our rental, the police or code enforcement have the discretion to write everyone a $250 ticket and to disburse the "gathering/party" immediately.  Please do not misrepresent your use of the property or the number of people that will be there - it is not worth it.  We do not rent out "party houses" nor do we allow gatherings above the approved guest list.

Rule #3  QUIET HOURS/OUTDOOR HOURS 

Quiet Hours:  Outside for all of our houses are from 9:00 PM to 10:00 AM on weekends and 9:00 PM to 9:00 AM on weekdays.  NO NOISE audible to neighbors is allowed during the Quiet Hours.  Any noise during other times of the day must be at a very reasonable level. Please remember you are renting a house in a residential neighborhood.

Outdoor Hours:  Per the City of Henderson, pool and spa outdoor hours are: 10 AM – 9 PM Saturday and Sunday, 10 AM – 9 PM Monday through Friday (sorry- not our choice but we must impose this). After 10:00 pm, you cannot be outside at all due to the noise ordinance in the City. Yes, this means light talking is still a violation.  We understand that some guests smoke, so we ask that they go outside alone to smoke and not have a gathering of people talking while smoking outside. The City rules are strict on this. If a noise complaint is filed, we will contact you by phone and app and are required to confirm immediately with the City the noise has ceased. You acknowledge we are required to have noise monitoring inside and outside. It only records decibels, no conversations are recorded or heard. . If we can not reach you or the noise does not cease, there is a risk that security or the police will be dispatched, and in that event, we will have to ask you to leave the property immediately. This is a straightforward rule to follow – move your evening activities indoors at 10 PM.

Also, noise must be at reasonable levels inside the home at all times. If you exceed the decibels, we will call you to ask you to turn down your music. This doesn’t preclude you from enjoying your stay or music. Any fines levied by the City of Henderson will be passed on 100% to the guest.

Rule #4  NO SMOKING!

All properties are non-smoking. Any guest found in violation will be charged an additional housekeeping fee of up to $1,000.00.  You acknowledge that smoking, vaping, hookah, or any kind of smoking/vaping is strictly prohibited inside the home, in the pool, in front of the home or on the outdoor furniture. If we see cigarettes left outside, burns in furniture or the deck, we will pursue you for all damages. Smoking outside can sometimes bring the smell inside the house with you, which will linger for the next guest, and therefore will also require additional cleaning – so please be mindful and don’t smoke near the doors and keep the doors closed . Any smoking of marijuana must be done in the backyard. It is a federal offense if you are smoking it in the front yard. NO OTHER DRUGS ARE ALLOWED.

Rule #5  PETS  

Some of our homes allow pets with a $500 per pet refundable deposit. Please check when making your reservation if pets are allowed.  Many of our homes are non-allergenic and pets are not allowed.  Bringing pets without permission will result in a $500 fine and immediate removal from the home.

Rule #6  TRASH

Please place your trash into the trash cans and/or recycle bins (in garbage bags). You will see a sign on the door inside the house indicating when trash day is.  We request guests to put the cans out and garbage out the night before and  bring the empty cans back the next day if you are still checked into the property.  We will also send you a text message for friendly reminders.

Rule #7  BE SAFE 

If applicable, the pool (and spa) is unattended and available for use at your own risk. Please do not allow any children to play in or around the pool without the supervision of an adult swimmer (even if the child is a good swimmer). The pool equipment is controlled remotely. Guest understands that no special efforts have been made to “childproof” this house and accepts the risk of harming any children on the property. These risks include but are not limited to: cleaning supplies that might be poisonous if ingested; no preventive measures to restrict access to a gas fireplace, sharp items; upper unit with stairs, a deck, antiques, etc.  

Lock Doors: Please keep the doors locked when not home. We also suggest you keep them locked when home too.  This is Vegas.  We have car prowlers all over our valley, so please do not keep anything valuable in your cars. Please lock all doors and windows when you depart.

Please turn down the stereo in your cars when in the driveway or driving down the street. The speed limit is 15 MPH.  If you are coming back to the house late at night, please be quiet while outside.

Rule #8  COMMENCEMENT OF OCCUPANCY

Check-in time is 4:00 PM or after. Should occupancy begin prior to 4:00 pm, additional charges may apply.  Please do not wear shoes in the house on carpets or rugs ➛ Please treat the home as you would if you were staying at a friend’s house. We appreciate it!  ➛ All garbage must be disposed of in the trash cans provided. 

Check-out is at 10:00 AM.   In the event that the guest does not vacate by 10:00 AM  upon completion of their occupancy,  additional charges may apply; unless other arrangements have been made in advance.  We need as much notice as possible if you wish to stay late as the cleaners are scheduled to come at 10 am and we need to check with them if they can come later. Please do not wait until the last day of your stay to request a late check-out. Please Clean Up!  We ask that you do as many dishes and laundry as possible before your departure. We realize some people have early flights and that is not always possible ➛Any bed that was used is not made on the final day so we make sure to wash the linen. ➛ Please put all garbage and recycling in the bins outside. ➛ Return any furniture that was moved ➛ Remove all personal property when you leave  ➛Unopened food items can be left in the kitchen and trash anything that is opened.  ➛Excessive cleaning or replacing towels or other things due to guest use will be billed to the guest.

Rule #9  VENDOR ACCESS

Pool, spa, landscaping, or pest control vendors will arrive at least once weekly. We do not know exactly when they will arrive and sometimes they do not come on scheduled days. They may come super early and do not usually ring the bells.  They cannot be turned away for any reason – any additional costs for vendors being turned away will be charged to the guest.

Rule #10  PARKING 

We only permit parking in the driveway or garage.  No more than 3 cars max can be parked at the property. Utilize the driveway or garage (if accessible) first, then street parking directly in front of the house. Under no circumstances may guests or visitors park in front of a neighbor’s house for any length of time! The property is in a residential neighborhood, the goal is to avoid interaction with neighbors as much as possible, or disruption to their day-to-day life.

ABOUT THE PROPERTY

IMPORTANT NOTICE:  All our properties are intended to be used as FAMILY or CORPORATE type rentals.  We do not allow large gatherings, parties, etc. at ANY of our houses.  In addition, we do not allow or tolerate loud noises outside.  

Notice of Monitoring & Security: PLEASE BE AWARE that the Trifecta Realty & Property Management utilizes the services of Security Company to provide real-time off-site monitoring and security services for the property. By entering into this Agreement, Guest acknowledges and agrees that Guest has been given prior notice of the security cameras and noise-monitoring sensors and consents to the same. Guest further acknowledges and agrees to the FINES/WARNINGS procedure. If any tampering of the security devices is discovered, the guest will be asked to leave the property immediately with no refunds. 

  • Security Video Cameras: The Property is equipped with security cameras that monitor the outside of the Property. There are NO security/video cameras located inside the Property. We DO have cameras inside the house facing the doors when the property is vacant.  There is one facing the front door and 1-2 facing the back door. No other cameras are inside the house.
  • Noise-Monitoring Sensors: The Property is equipped with noise-monitoring sensors inside and outside the Property. The noise-monitoring sensors do not record audio and only send an alert to the Security if it detects excessive noise. If Security receives an excessive-noise alert, it will be deemed a violation of this Agreement and the FINES procedure detailed below will apply.
  • Our Security Department monitors our property 24 hours per day 7 days per week to ensure the safety of our guests and to protect our neighborhood from unauthorized events or parties. 

Accidental Damage:  Guests will be completely responsible for all damage caused by Guests.  Guests will be charged for any missing items reasonably attributable to Guests and not returned after notification. The cleaning service performs an inventory/survey of the property after Guests depart and notifies the Trifecta Realty & Property Management of any missing items. Trifecta Realty & Property Management will notify guests in the event that items were inadvertently taken, and provide guests the opportunity to return the missing items. 

Swimming Pool (If applicable): This rental property has a swimming pool and hot tub located on the grounds. Guests will use the swimming pool and/or hot tub at the guest's own risk. The Trifecta Realty & Property Management or Property Manager will not be held responsible for the injuries, including death, sustained by the guest and/or the guest’s occupants or guests when using the swimming pool and/or hot tub, and the guest will notify the Trifecta Realty & Property Management of any actions resulting from injuries to guest and/or guest’s occupants or guests. Guests are not allowed to touch the pool controls. Everything is done remotely by the property manager.  If you want the heat or the spa turned on, text the number we leave you to have this done. There is a $500 fine if you are seen trying to bypass the pool controls manually.

Flooring: There are a lot of upgrades done to the homes. We ask that you do not drag your suitcases and other items on the Luxury Vinyl Plank floors and/or Carpets. We also request no shoes be worn as there is a dark coating on the streets in Vegas and it makes a mess on the floors.  We have brooms, dustpan and mop in the closet under the stairs. Please use only the solution on the shelf provided with the mop for the floors.

House Cleaning & Supplies (If applicable): You will receive a list of  house cleaning supplies (included in our Guest Book) for countertops, quarts, floors,  pans, tables, fridge, etc. This also includes special instructions on how to take care of them and the place where it is located in the house you are staying.  We also have a special cleaning solution for each and we do not use Lysol wipes or harsh cleaning chemicals. 

Guest Book  (If applicable): You will receive a “Guest Book” with specific info on the property which you will be staying and having a good stay. We appreciate you being a responsible guest and we will do our best to help you have a great stay!

FINAL DISCLAIMER

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and guests will not be permitted to check-in. 

Registered guests and their visitors understand that Trifecta Realty & Property Management and/or the owner of the property is not responsible for any personal injury caused by slipping on wet pavement or surfaces, and that tenants are responsible for exercising care when surfaces are wet or slippery due to weather or use of hoses to wash down areas, and further, that Trifecta Realty & Property Management and/or the owner of the property is not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul,  inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves,  tenants’ failure to take adequate precautions around wet areas, or any unforeseeable circumstances. 


*This agreement and disclaimer applies to Guests and all guests in the Guests’ group for this Short Term Rental. I,  the Guest, have read, understand, agree to, and will abide by this rental agreement and all conditions stated herein.
